Terms and Conditions

1. General Requirements

1.1. Participants must be at least 16+ years of age to be able attend a language class at the Goethe-Zentrum Kathmandu (hereinafter GZK). Proof of age shall be produced at the time of registration. In case a participant is less than 18 years of age at the time of registration the respective legal guardian must provide proof of consent in this matter in written form to the GZK and shall seek immediates counsel from the administration and language department of the GZK.

1.2. Every person enjoying a service of the GZK, such as a language class or an exam (a.o.) agree to these General Terms of Business (GToB) once registered for such service. The GToB are publicly available at the reception of the GZK as well as the website of the GZK: www.goethe-kathmandu.edu.np

A   LANGUAGE COURSES

2. Registration & Placement
2.1. Registration takes place via the internet presences of the GZK (www.goethe-kathmandu.edu.np or/and the Social Media channels of the GZK). In case technical or other challenges arise, students shall consult the reception of the GZK immediately.

2.2. Students who want to join a course on the levels A2 – C1 have to provide a German Language Certificate acquired by an acknowledged educational institution. The GZK reserves the right to conduct a placement test if such a certificate is older than 12 months at the students expenses.

3. Fees
3.1. The contractually binding course fee complies with the current price list at the time of registration. Current prices can be found via the website of the GZK or at the reception of the GZK during business hours.

3.2. Cost for books, CDs and further course material are NOT included in the language course fee unless stated otherwise.

3.3. Fees for exams are NOT included in the course fee.

3.4. Any bank fees that shall arise in the course of course-fee-payment are to be borne by the participant.

4. Terms of Payment
4.1. The course fee is due in full at the time of registration and may be payed via bank transfer, cash or mobile money service like eSewa.

4.2. If payment is not received in full by the GZK by the time the course starts the participant loses the right to take part in the course.

4.3. Payment in instalments is not possible.

4.4. Payment shall ONLY be initiated if a client is asked by the GZK to do so in the course of an enrolment process. Payments without cause may NOT be refundable

5. Cancellation
5.1. Each participant has the right to withdraw from or cancel a course without providing reasons under the following circumstances:

A) In case of a cancellation till the day the course starts the GZK charges a cancellation fee of 10% of the general course fee.
B) In case of a cancellation during the course, that is from its first day onwards, the GZK charges a cancellation fee of 100 % of the general course fee.

5.2. Any cancellation has to be made in writing. For a valid cancellation, the GZK must receive the written cancellation via mail or at the reception of the GZK in the respective deadline.

5.3. In case of sickness or similar circumstances that the participant is not culpable for an extraordinary cancellation is of a course is possible. Such cancellation has to be made in writing. The participant has to explain his or her reason in detail. If confirmed and approved by the GZK the participant receives a refund as follows

A) In case of a cancellation until the completion of the first 4 weeks the participant we receive a refund of the course fee minus an administrative fee of 50% of the course fee
B) In case of a cancellation from the first day of the fifth week of the course onwards the GZK charges a cancellation fee of 75% of the course general course fee. The participant receives a refund of 75% of the general course fee.

5.4. The GZK reserves the right to cancel a course if the minimum number of participants is not reached. In this case, the participant receives a refund of any fees the participant might have already paid.

6. Attendance Certificates | Class suspension
6.1. Provided a participant completes no less than 80% of all lessons and homework he/she will obtain a certificate of participation by the GZK.

6.2. A participation certificate issued by the GZK is not suitable to serve as proper proof of language knowledge towards German authorities or universities.

6.3. In case a class has to be suspended on short notice due to the unavailability of the teacher the GZK will offer a suitable surrogate-date.

7. Online Courses
7.1. It is the obligation of each participant to ensure the availability of the necessary equipment and technical conditions.

7.2. The general terms of payment apply in accordance with number 4. of these general terms of business.

7.3 Participants who have booked an online course or take already part in such course can’t shift into an analog course organized by the GZK.

7.4 Each participant may receive a certificate of participation if he/she attends no less than 80% of the offered online live sessions and completes 80% of the given tasks and homework. Further rules as conveyed by the teacher or the management of the GZK may apply. A participation certificate issued by the GZK is not suitable to serve as proper proof of language knowledge towards German authorities or universities.

8. Feedback & Grievances
8.1. In case a student has a feedback or criticism concerning his/her language class he/she shall register his/her grievances directly with her/his teacher first.

8.2. In case grievances can’t be solved in class the student shall present his/her concerns to: language@goethe-kathmandu.edu.np

B   EXAMS

9. General Terms & Requirements
9.1. To continue studying at the next level at the GZK each course participant has to take and pass an official exam. Registration for such an exam has to be conducted separately and is not included in the registration for a course.

9.2. A participant can enroll in an exam of his/her choosing for an unlimited amount of attempts.

9.3.Once a participant enrolled in an exam at the GZK this particular seat is NOT transferrable to another person.

9.4. In case an examinee loses his/her exam certificate he/she can request the issuance of a substitute certificate.

9.5 All personalized data will be handled by the GZK and the Goethe-Institut only in the framework of the respective exam and will not be forwarded to third parties

10. Exam Fees
10.1. Exam fees are NOT included in the course fee.

10.2. The contractually binding fee is stated in the price list at the time of registration. The list can be consulted at the reception of the GZK during business hours or at the website of the Goethe-Zentrum Kathmandu.

10.3.The payment deadline will be given by the GZK at the time of registration. If payment is not received in full by the GZK at the respective given deadline the participant loses the right to take part in the exam

10.4. Once registration is completed and the fee has been paid a refund is NOT possible

11. Terms of Payment
11.1. The exam fee is due in full at the given deadline and may be payed via bank transfer, cash deposit at bank or mobile banking service

11.2. Payment in instalments is not possible.

11.3. Payment shall ONLY be initiated if a client is asked by the GZK to do so in the course of an enrolment process. Payments without cause are NOT refundable.

11.4. Any bank fees that shall arise in the course of exam-fee-payment are to be borne by the participant.

12. Proof of Identity

12.1. On the day of the exam at the Goethe-Zentrum Kathmandu it is absolutely MANDATORY for examinees to present their ORIGINAL Citizenship ID | Passport or National ID which includes a current photograph of themselves. The ID has to be presented before the beginning of the exam and/or at any other point as necessary or on demand. Driving Licenses, photocopies of official documents or digital copies WILL NOT BE ACCEPTED!

12.2. If a passport or citizen’s ID has been deposited with the German Embassy the examinee shall inform the German Embassy via eMail. The Embassy will provide the passport for the day of the exam. Copies of official ID documents – be it digital or analogue – will NOT BE ACCEPTED

13. Postponement of an Exam

13.1. Each examinee has the right to ask for one postponement of his/her already scheduled exam free of cost due to these reasons only:

  • The examinee gets sick. In such case a valid doctor’s letter stating the inability of the examinee to attend the exam shall be presented to the GZK no later than 2 weeks after the exam date – at which time the GZK shall propose an alternative date at the next available opportunity to the examinee. A waiting time may occur. If a doctor’s letter can’t be provided the examinee forfeits his/her exam seat and the GZK charges a cancelation fee of 100 % of the exam fee.
  • Cases of extraordinary hardship such as paralysis, loss of sight and hearing and similar occurrences.

14. Exam Guidelines

15. Re-Evaluation & Feedback

15.1. An examinee has the right to ask for a re-evaluation of his/her exam.

15.2.In case an examinee has a grievance he/she shall register the same IN PERSON with the Exam Department at the GZK. Appointments shall be made via: exam@goethe-kathmandu.edu.np

C   MISC

16. Liability

16.1. The liability of the Goethe-Zentrum Kathmandu is limited to premeditation and gross negligence.

16.2. The GZK can’t be held liable for the complete or partly cancellation of courses due to force majeure such as – among others – a pandemic, fire, war, a natural disaster, political turmoil, governmental rules, decrees and orders etc. or any other reasons that lie beyond the control or sphere of influence of both parties

17. Validity

The version currently published on the website of the Goethe-Zentrum Kathmandu [www.goethe-kathmandu.edu.np] and/or at the reception of the GZK is the currently effective version. The currently valid version replaces any earlier version.
